PRODUCTION PACK

RESERVATION TERMS

Effective Date: June 29, 2026

These Reservation Terms govern the booking, delivery, and logistical handling of your equipment from Losco Studios LLC, a New Jersey limited liability company doing business as Cosmo Losco Films (“the Studio,” “we,” “us”). By completing your online checkout, you agree to be bound by these terms in their entirety.

1. Reservation Confirmation

Your production dates are not secured until your checkout payment is successfully processed and the Studio issues an official order confirmation email. If you do not receive a confirmation email within five minutes of transaction completion, please contact production@loscostudios.com immediately to verify your order status.

2. Cancellation & Refund Schedule

Because our equipment inventory is tightly allocated to specific calendar blocks, cancellations are subject to the following timeline:

  • 30+ Days Prior to Scheduled Event Date: 100% refund of the total order balance.

  • 15–29 Days Prior to Scheduled Event Date: 50% refund of the total order balance.

  • 14 Days or Fewer Prior to Scheduled Event Date: Entire balance is non-refundable. At this stage, your specific Production Pack is locked to your calendar dates and cannot be re-booked on short notice.

 

Studio Protection Rule: In the rare event that the Studio must cancel your reservation due to hardware damage by a previous renter, transit failure, or equipment loss, you will receive a 100% immediate refund plus a 20% good-faith credit toward any future booking.

3. Date Adjustment Policy

  • 14+ Days Notice: Free date rescheduling, subject entirely to inventory availability within The Production Pack Series.

  • 7–13 Days Notice: Date changes incur a flat $50 administration rescheduling fee.

  • Fewer than 7 Days Notice: Date shifts are treated as a full cancellation under Section 2, requiring a new separate booking for the alternate dates.

4. Shipping, Logistical Bounds & Lithium-Ion Transport

  1. Carrier & Tracking: We utilize the United States Postal Service (USPS) for all physical fulfillment. Shipping transit times are calculated based on your regional distance to guarantee your package arrives 1 to 2 days prior to your scheduled event date. You will receive an automated tracking link the moment your pack leaves our facility. Our baseline delivery responsibility concludes upon the carrier registering a definitive "delivered" tracking status scan.

  2. Geographic Scope: We service the contiguous United States only (the lower 48 states and Washington D.C.). We do not ship to Alaska, Hawaii, U.S. territories, international destinations, or APO/FPO/DPO military addresses.

  3. Why Ground Rules Matter: Our Production Packs travel exclusively via specialized ground transit because they contain professional lithium-ion camera batteries. Federal aviation limits on air-shipped consumer batteries require restrictive charging states that would result in you receiving dead or partially drained batteries. Ground shipping allows us to deliver fully charged, studio-ready power packs straight to your door.

  4. Transit Exceptions: If USPS fails to complete delivery on schedule despite the Studio tendering the pack on time, we will overnight a replacement kit at our expense (when logistically feasible) or issue a complete refund under our service guarantee.

  5. Address Errors: If an address entry error on your part results in a delivery failure, you are liable for the actual carrier reshipping fees (typically $35 to $75). A second failed delivery attempt stemming from incorrect client data will trigger an automatic reservation cancellation under our 50% refund tier.

5. Mandatory 24-Hour Arrival Verification

You are contractually required to open, inspect, and test all equipment within twenty-four (24) hours of carrier delivery. You must power on the camera units, mount the auxiliary lenses, engage the wireless microphones, and confirm successful file recording and playback functions. If any mechanical discrepancy or transit damage is detected, notify production@loscostudios.com immediately so we can ship a replacement unit.

Discovering a hardware issue on your actual wedding day that could have been identified during this mandatory 24-hour testing window limits our ability to assist you. A full refund is not available if you have held the gear for over 24 hours without logging a complaint.

6. Carrier Return Rules & Tracking Timestamps

Your package must be deposited at an authorized USPS branch or handed directly to a postal carrier by 11:59 PM local time on your designated return date.

The carrier's initial digital intake tracking scan serves as the definitive source of truth regarding your return timestamp. Please utilize the prepaid return label provided inside your equipment transport box. Late return fees will automatically begin accumulating on the second calendar day following your scheduled return date, as detailed in our unified Late Return Policy.

7. Rental Custody & Operational Obligations

During the active rental period, you agree to:

  • Retain direct personal custody of the Equipment at all times. Do not store gear in unattended, unlocked, or public vehicles; vehicle theft is strictly excluded from protection plan coverage.

  • Prohibit sub-leasing, lending, or transferring the production gear to any third party outside your immediate event circle.

  • Operate all hardware safely, reasonably, and in accordance with our provided digital quick-start guide and standard manufacturer recommendations.

  • Return every piece of hardware, micro-cable, and accessory outlined on your package manifest. Missing pieces will be billed at flat-rate replacement fees.

8. Reservation Transferability

Bookings are non-transferable to other events or distinct account holders without formal written approval from the Studio. The primary account names provided at checkout are authorized to make adjustments, sign disclosures, or manage booking details.

9. Studio Assurances & Service Bounds

  • What We Guarantee: We guarantee that all equipment will arrive fully functional, clean, and matching the specific packaging tier selected. We guarantee that all gear undergoes comprehensive inspection and maintenance between events.

  • What We Do Not Guarantee: We rent out professional production tools, not filmmaking talent. We do not guarantee the artistic quality, exposure accuracy, framing choice, or overall aesthetic success of your footage. Furthermore, standard cosmetic surface wear (such as light chassis scuffs or grip wear) that does not disrupt functionality is expected on active rental inventory and is not grounds for rejection.

10. Strict Limitation of Liability

The total aggregate liability of Losco Companies LLC for any claim arising from a rental—including equipment malfunction, data corruption, media card failure, or transit delays—is strictly capped at the exact total amount paid by the Client for that specific rental order.

The Studio is not financially liable for consequential, incidental, emotional, or punitive damages, including the loss of irreplaceable event footage, audio dropout, missed timeline moments, or a failure to meet your creative cinematic expectations. We strongly encourage all clients to test gear immediately upon arrival and to secure third-party wedding event insurance for high-value celebrations.

11. Assumption of Real-World Operational Risk

Professional filmmaking hardware is inherently sensitive and high-value. By accepting physical delivery of our production packs, you knowingly assume all operational risks associated with real-world handling. Consumable assets such as data storage cards and batteries are recognized as standard wear-and-tear items and are not protected under standard damage caps.

12. Force Majeure Clauses

Neither party shall be held legally responsible for fulfillment failures or scheduling breaches caused by events beyond reasonable human control. These occurrences include natural disasters, extreme hazardous weather events, unexpected acts of government, civil emergencies, or sudden systemic shipping carrier shut-downs. In these instances, the Studio will coordinate in good faith to reschedule your booking window, offer alternative asset adjustments, or process service credits.

13. Explicit Authorization to Charge

By agreeing to these terms, you grant Losco Studios LLC explicit authorization to charge your payment method on file for any of the following balances accrued post-event:

  • Structural Equipment Damage: Assessed under our Equipment Protection Plan parameters (capped at a $250 deductible for covered occurrences if opted-in; billed at full market repair rates if opted-out or if the damage is explicitly excluded).

  • Late Return Penalties: Billed daily in accordance with the Late Return Policy.

  • Replacement Values: The flat-rate retail cost for any missing components or accessories not enclosed in your return box.

  • Emergency Procurement Costs: Documented outside vendor equipment costs if your late return blocks or compromises a subsequent customer's active reservation.

  • Administrative Fees: Cleaning penalties ranging from $50 (minor soil) to $200 (major environmental or biological residue) if equipment requires professional restoration.

Transparency Protocol: Prior to executing any post-event charge, the Studio will email you an itemized damage assessment containing photographic proof (where applicable). This initiates a strict five (5) business day review and dispute window.

14. Mediation & Local Jurisdiction Disputes

Most logistical concerns can be swiftly handled by contacting our studio team at production@loscostudios.com within your 5-day assessment window. If a conflict cannot be resolved through cooperative email dialogue, both parties agree to submit the dispute to formal mediation in Gloucester County, New Jersey, prior to initiating any civil litigation.

15. Term Stability & Future Modifications

The Studio reserves the right to adjust our baseline reservation terms periodically. However, your specific rental is entirely frozen at the exact contractual version active on the day you placed your order. Future policy adjustments apply strictly to subsequent transactions.
