DAMAGE WAIVER

Effective Date: June 29, 2026

The Bottom Line

With the Waiver ($50): Your maximum out-of-pocket liability is capped at a flat $250 for covered accidental incidents. Losco Studios LLC absorbs all repair or replacement costs exceeding that amount.

Without the Waiver: You assume full financial responsibility for all necessary repairs or complete retail replacement costs of the equipment.

 

Overview

The optional $50 Equipment Protection Plan is a liability cap designed to safeguard you against the unexpected realities of a wedding weekend. This plan is not an insurance policy, nor does it absolve you of your responsibility to care for the gear; it simply shields you from major financial liability for standard, accidental mishaps.

What is Covered

When opted into the protection plan, your liability is capped at $250 for accidental operational damage, including:

  • Accidental impacts, drops, or falls during normal handling (e.g., cracked lenses, broken filters, or dented bodies).

  • Incidental, minor moisture exposure on weather-sealed items (such as a light rain drizzle or minor champagne spray).

  • Physical damage caused by a sudden camera strap or mounting component failure.

What is Excluded

The following situations are strictly excluded from protection plan coverage. If any of these occur, you are liable for the full replacement or repair costs, regardless of waiver status:

  • Theft & Mysterious Disappearance: Any stolen gear. A formal police report is strictly required for any item valued over $500.

  • Unattended Vehicles: Equipment stolen or damaged while left inside a vehicle.

  • Loss: Any gear, parts, or cases that are simply missing or not returned in the original shipment box.

  • Severe Water Damage: Gear dropped in pools, left unprotected in downpours, or fully submerged.

  • Abuse & Intentional Misuse: Damage resulting from malicious intent, vandalism, or operating the gear in direct violation of our provided quick-start guides.

  • Consumables & Wear Items: SD cards, batteries, power bricks, cables, lens caps, and straps.

  • Late Returns: Overdue return penalties are governed strictly by our Late Return Policy, not this waiver.

 

Please Note: Standard, purely cosmetic wear-and-tear (minor surface scuffs or tiny scratches that do not impact functionality) is expected and will never result in a charge.

Missing Items & Accessory Replacement Rates

Missing accessories are not processed as complex damage claims; instead, they are billed at flat-rate replacement fees. Because these are lost items, the waiver does not apply to them.

  • SD Card: $90

  • Camera Battery: $140

  • Battery Charger / Hub: $60

  • Interconnect Cable (USB-C / HDMI): $20

  • Lens Cap: $20

  • Camera Strap: $25

  • Wireless Microphone Transmitter/Receiver: $90

Real-World Examples

Scenario A — Covered Event

An enthusiastic wedding guest drops your main production camera, shattering the lens elements.

  • Authorized Repair Estimate: $1,600

  • With Protection Plan: You pay the $250 cap. Cosmo Losco Films covers the remaining $1,350.

  • Without Protection Plan: You pay the full $1,600.

Scenario B — Excluded Event

A production pack is left overnight on a hotel balcony and is stolen.

  • Equipment Replacement Cost: $3,500

  • With Protection Plan: You pay $3,500 (Theft is excluded).

  • Without Protection Plan: You pay $3,500.

Scenario C — Negligible Wear

A camera cage incurs a minor scratch during the reception but remains perfectly functional.

  • Studio Assessment: $0 (Normal wear-and-tear is free).

  • With or Without Protection Plan: You pay $0.

Plan Parameters & Limits

This protection plan applies per order, not per individual piece of gear. A single $250 cap covers the collective sum of all covered accidental incidents during your specific rental timeline.

How Costs Are Assessed

Damage evaluations are based on actual repair invoices from authorized manufacturer service centers (such as Canon, or DJI) or current retail pricing for identical SKUs via established industry suppliers (i.e. B&H Photo & Video). All itemized damage emails will contain direct source documentation for complete transparency.

Dispute Window & Resolution

You have five (5) business days from the receipt of our itemized damage assessment email to review, respond, or present your own photographic/written evidence regarding the incident. Once this 5-day window closes, the finalized amount will be automatically charged to your payment method on file under the Authorization to Charge terms of your agreement.
